Injured in a nursing home fall or elopement in Florida? Learn about fall risk assessments and facility duties.
Resident Falls and Wandering (Elopement) in Florida Facilities
Seniors residing in long-term care facilities require tailored supervision to prevent dangerous falls and wandering. When facilities cut staffing levels, vulnerable residents suffer preventable fractures, head trauma, or life-threatening elopement incidents.
Comprehensive Fall Risk Assessments
Under Florida administrative rules, nursing facilities must complete a comprehensive Fall Risk Assessment upon resident admission and update it continuously:
- Identifying Risk Factors: Evaluating muscle weakness, medication side effects, cognitive impairment, and mobility history.
- Implementing Prevention Controls: Installing bed alarms, low beds, floor mats, and assigning dedicated ambulatory assistance.
- Environmental Hazard Audits: Keeping hallways clear of clutter, wet floors, and inadequate lighting.
Elopement and Wandering Hazards
Elopement occurs when a resident with dementia or Alzheimer's leaves a facility unsupervised. Facilities are required to maintain secure door alarms, window locks, and wander management technology (such as RFID bracelets) to prevent residents from wandering into dangerous traffic or extreme weather.
Under Fla. Stat. § 400.139, claims involving nursing home fall injuries or elopement must be filed within two years.
